Where work is scheduled for a period of ten (10) hours, a third rest break will be taken at the end of eight (8) hours. Time of these breaks shall be mutually agreed upon and the entire crew may take the break simultaneously. Accumulated lieu time cannot exceed 37.5 hours for 7.5 hour workers and 40 hours for 8 hour workers.Ĭoffee Breaks Two (2) breaks of ten (10) minutes each but not more shall be allowed during the regular shift. Where an employee chooses the latter option, such time off must be taken within the succeeding six (6) pay periods of the occurrence of the overtime at a time mutually agreeable to the Hospital and the employee, or payment in accordance with the former option shall be made. Overtime Lieu Time Where an employee has worked and accumulated approved overtime hours (other than overtime hours related to paid holidays) such employee shall have the option of electing payment at the applicable overtime rate (i.e., where the applicable rate is time and one-half, then time off shall be at one and one-half times). Work time includes time during which an employee: When an employee works overtime they will be granted an unpaid one-half (1/2) hour break five Lunch Break When an employee works five (5) continuous hours or more he/she shall be given an unpaid one- half (1/2) hour lunch period commencing between the fourth (4th) and fifth (5th) hour of work. and l:00 p.m., otherwise he shall be paid double time for working through said lunch period. In the event that an employee is required to work during his regular lunch period he shall be allowed a one-half hour lunch period between the hours of ll:30 a.m. Lunch Breaks The lunch break will consist of a one-half hour (or one hour where scheduled) unpaid break taken mid-way during regular work day. Such time shall not be cumulative and shall be in addition to break time established above. Employees who spend a majority of the workday working with a Video Display Terminal (VDT) shall be permitted to perform other job-related duties (i.e., work not involving use of a VDT) 10 continuous minutes out of each hour. For work assignments of less than six hours, such employees shall be entitled to one 15-minute break. Leave to participate in a Memorial Day event shall be paid or unpaid, at the discretion of the employer.Įmployers are not required to provide leave where an employee provides services that “are essential and critical to the public health or safety and determined to be essential to the safety and security of such an employee’s employer or the property of the employer.Break Time For daily work assignments of six or more hours, permanent and probationary employees (except bus drivers and bus aides) shall be entitled to one 15-minute break for each half of the work assignment. Leave shall be granted with or without pay, at the discretion of the employee’s employer.Įmployers are not required to provide leave where an employee provides services that “are essential and critical to the public health or safety and determined to be essential to the safety and security of such an employee’s employer or the property of the employer.”Īll private employers must grant leave to a veteran employee who desires to participate in a Memorial Day exercise, parade or service. Employee veterans are entitled to leave “of sufficient time to participate” in an event that takes place in the veteran’s “community of residence.” 149, § 52A½, as amended by, Section 32 of Chapter 218 of the Acts of 2018Įffective November 7, 2018, all private employers must grant leave to a veteran employee to observe Veterans Day. An employee who is a veteran may be entitled to paid or unpaid leave to observe Veterans Day and to participate in a Memorial Day event.
